As long as your devotion to blue and black is less than 6, Battle Pigeon is not a creature.

Whenever one or more creatures you control deal combat damage to a player, you may look at that player's hand. If battle pigeon is one of those creatures, you may exile a non-land card from that player's hand and cast it without paying it's mana cost. Otherwise that player discards a card.
