As long as it is day, Threnody Shade is not a creature.

While Threnody Shade is a creature, it has the following abilities: Whenever a player plays an instant, Threnody Shade deals 1 damage to that player. Whenever a creature attacks, Threnody Shade deals 1 damage to that creature. Whenever a creature dies, you may pay {3}{b}. If you do, create a token that is a copy of Threnody Shade.
